"Ticket To Ride" Official Rules

Eligibility: The TORNADOS "Ticket to Ride" Sweepstakes (the "Promotion") is open only to legal residents of the United States (and the District of Columbia), who are 18 years old and older at the time of entry. Employees of Ruiz Food Products, Inc., SCAinteractive, Stewart-Haas Racing, LLC., True Speed Enterprises, Inc., Ryan Newman Motorsports, Inc., Retail Sports Marketing, Inc. and their parent companies, subsidiaries, affiliates, and their respective agents, prize providers and agencies that are involved in this Promotion, and the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. By participating, entrants agree to be bound by the Official Rules and the decisions of the Independent Judging Organization ("Judges") which administer this Promotion. Sweepstakes begins on April 11, 2010 and ends on August 13, 2010.

Entry: The Promotion begins April 11, 2010 at 12:00:01 a.m. Eastern Time ("ET") and ends August 13, 2010 at 11:59:59 p.m. ET (the "Promotion Period").

How to Enter: You will need to obtain an 8 digit code ("Code") to enter the Promotion. There are two (2) ways to obtain a Code: a. TORNADOS In-Pack Collectible Card: During the Promotion Period, purchase specially marked packages of TORNADOS products, which include an in-pack collectible card with Code. Participating products are available at participating stores while supplies last; or b. To Request a Free Code: You may request a Code by mailing your request along with a hand-printed self-addressed, first-class stamped envelope to: TORNADOS Ticket to Ride Sweepstakes, PO BOX 481615, Charlotte, NC 28269. Residents of VT may omit return postage. Limit one request per stamped outer mailing envelope per day. Mail-in requests must be postmarked by August 13, 2010, and received by August 19, 2010. Once you have obtained a Code, visit www.mytornados.com ("Website") and follow the links and instructions to complete the entry form. After you submit the required information on the entry form, including your Code, you will automatically receive one Promotion entry for a chance to win the Grand Prize. You will also be notified as to whether you have won one of the First, Second or Third Prizes. You may enter your Code up until August 25, 2010 at 11:59:59 p.m. ET. Limit: Up to two Promotion entries per day during the Promotion Period per valid email address.

Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified.

Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by that entrant. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.

By entering, you fully and unconditionally accept these Official Rules and the decisions of the Judges, which are final and binding in all respects. Illegible and incomplete entries are void. Sponsor is not responsible for lost, late, mutilated, postage due, or for electronic, network or computer/scanner failures or malfunctions, or other technical errors of any kind. All entries become the property of Sponsor and will not be returned. Limit of one prize per household for this Promotion.

Selection of Potential Winners: There will be 819 random, computer-generated winning times for First, Second and Third Prizes. All eligible entries received during the Promotion Period will be entered into a random drawing for the Grand Prize, which is scheduled to take place on or about August 26, 2010. Decisions of Judges are final on all matters. Potential Grand Prize winner will be notified within five (5) business days of the drawing. Except where prohibited, the potential Grand Prize winner will be required to complete and return an affidavit of Eligibility and Liability/Publicity Release within ten (10) days of being notified. If a potential Grand Prize winner fails to sign and return the affidavit/release within the required time period, or if he/she cannot be contacted within five (5) days of the first attempt to notify him/her, or if Judges determine, under these Official Rules, that he/she is ineligible, then he/she will forfeit the prize, and an alternate potential Grand Prize winner will be selected at random from among all remaining eligible entries. Travel companions must sign and execute a Liability/Publicity Release prior to travel, except where prohibited. Any travel companion who is a minor must travel with his/her parent or legal guardian. First, Second and Third Prizes are randomly seeded throughout the Promotion Period with at least one winning time per day. The time of successful Code submission that is received and recorded by the Game Computer on or after a randomly designated winning time will determine if the participant is a winner of the First, Second or Third Prize. If no successful Code submission is received and recorded by the Game Computer at the randomly designated winning time, the prize will remain available until it is awarded. In the event that there are not enough players to award all prizes, then Prizes that are not claimed will not be awarded. Odds of winning are dependent on the date and time of entry. The odds of winning the Grand Prize will be determined by the number of all eligible entries received.

Prizes: One (1) GRAND PRIZE: A TORNADOS Racing "Experience of a Lifetime," Grand Prize consists of: a three (3) day, two (2) night trip for two (2) to Charlotte, NC, scheduled for September 27-29, 2010, roundtrip coach air transportation between a major metropolitan airport near winnerâ€™s home (as determined by Sponsor in its sole discretion) and Charlotte Douglas International Airport, standard double occupancy accommodations for two (2) (one (1) room) for two (2) nights at a hotel of Sponsorâ€™s choice, two (2) Richard Petty Driving Experience Rookie Experiences, two (2) Richard Petty Driving Experience Ride-Along Experiences, transportation to and from event and $500.00 cash for the winner. Airfare may be substituted with ground transportation in Sponsorâ€™s discretion if Grand Prize winner resides in (or within 150 mile radius of) Charlotte, NC. Approx. Retail Value (ARV): $2,800.00. Trip must be taken on days listed or prize will be forfeited. No cash or other substitution or transfer of prize, except by Sponsor, as described below. Thirty-nine (39) FIRST PRIZES: A TORNADOS autographed #39 1:24 scale die-cast car, ARV: $49.99. Three hundred ninety (390) SECOND PRIZES: TORNADOS hat and hero card, ARV: $19.99. Three hundred ninety (390) THIRD PRIZES: TORNADOS t-shirt and hero card, ARV: $14.99. Total ARV of all Prizes: $18,391.81.

All federal, state and local laws apply. Grand Prize winner will receive an IRS form 1099 for the value of the prize. All federal, state and/or local taxes and any other costs associated with the Grand Prize are the sole responsibility of each winner. Prizes consist of only those items specifically listed as part of the prize. Sponsor reserves the right to substitute any prize with prize of equal or greater value if prize becomes unavailable for any reason. Any expenses associated with prize receipt and/or use that are not expressly described in these Official Rules are the responsibility solely of the winner.

Publicity Release: Acceptance of any prize constitutes permission to the Sponsor to use winner's name, voice, signature, images and likenesses for purposes of advertising and trade, in any medium, without further compensation, unless prohibited by law. Except where prohibited, participation in the Promotion constitutes an entrant's consent for Sponsor and its agents to use entrant's name, likeness (including photograph), voice, opinions, biographical information and state of residence for promotional purposes in any medium without further payment or consideration.

General Conditions: In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but, not limited to, fraud, technical failures, regularly scheduled maintenance, virus or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (b) cancel the Promotion and award the prizes in a random drawing from among all eligible entries received up to the time of impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor;s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Release and Limitations of Liability: Except where prohibited, by participating in the Promotion, entrants agree to release and hold harmless Ruiz Food Products, Inc., SCAinteractive, Stewart-Haas Racing, LLC., True Speed Enterprises, Inc., Ryan Newman Motorsports, Inc., Retail Sports Marketing, Inc., Richard Petty Driving Experience, Speedway Motorsports, Inc., and their respective parents, subsidiaries, affiliates, promotional partners, prize partners, and their respective agents and agencies, and their respective officers, directors, employees and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of the Promotion or the processing of registrations and entries; (e) late, lost, or undeliverable mail; or (g) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt of any prize. Entrant further agrees that in any cause of action, the "Released Parties" liability will be limited to the cost of entering and participating in the Promotion and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another Promotion entry; provided that if it is not possible to award another entry for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

Disputes: Except where prohibited, entrant agrees that (a) any and all disputes, claims and causes of action arising out or connected with the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of California or the appropriate California State Court located within Fresno County, California; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Promotion, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
